Bugenig v. Hoopa Valley Tribe, Docket 01-900,  the Ninth Circuit Appeals Court denied a non-member on fee land within the reservation, the right to cut and harvest trees on her own property. This case acknowledges a tribe?s jurisdiction, under a tribal constitution, but the case does not overrule or address "Oliphant" or other tribal inabilities to regulate or enforce against non-Indians.
